Question
Someone objected to the answers on www.sunnipath.com about the validity of ‘Following Another Madhhab’ by saying, on a Sunni discussion forum:
Answer
Assalamu alaikum,
The position of Ibn Abidin, and the majority of later Hanafi scholarship (including Imam Shurunbulali, Imam Haskafi, Imam Abu’l Su`ud al-Masri, Sayyidi Abd al-Ghani, and Imam Tahtawi), as well as the living Hanafi jurists of Syria and other Arab countries, is that:
It is permitted for a morally responsible person to follow any of the four Sunni schools of law on any issue [not only when there is difficulty], if two conditions are met:
a) That one follows the other school’s position properly, fulfilling the conditions and integrals; and
b) That does not make it one’s inveterate habit to seek out the easiest position on all matters (tatabbu` al-rukhas), as this leads to corruption (fisq). [Ibn Abidin, Radd al-Muhtar]
The works of Hanafi usul, such as al-Taqrir wa’l Tahbir Sharh al-Tahrir and Fawatih al-Rahamut, explain the theoretical underpinnings of this issue.
This is the practice of the Sunni ulema of Syria and Yemen—lands which are the fortresses of guidance by Prophetic promise. This is how they give fatwa, and in it there is mercy, when applied with good intent and in the spirit of the guidance of the Beloved Messenger of Allah (Allah bless him and give him peace).
Yes, the noble ulema of the Indian Subcontinent generally disagree—as explained in the answers below. However, even they make clear allowances for scholars pointing to dispensations when their judgment deems that more beneficial to the situation in general or the affected person’s situation in particular, if the person giving the dispensation understands the other school’s position clearly and reliably. This is often not possible in the context of the Subcontinent because of the lack of genuine scholars of the other schools. This, however, is not the case in other places where such scholars exist.
When someone follows a valid position within Sunni scholarship (as opposed to an aberrant position), it is not legally permitted to think ill of them nor to impute ill intent—doing either would be sinful. We should remember the general principle that,
“There is no condemnation in matters of [genuine] difference of opinion.” [Ibn `Abd al-Salam, Zarkashi, and others; Mawsu`a Fiqhiyya]
Yes, caution is needed because many may fall into following their whims and will not make sure their action is sound according to the other school. But this is a darkness whose cure is the light of knowledge when sought with the light of sincere intent.

The Path of Taqwa: Avoiding Differences of Opinion
This is important to remember, because, as Imam Shatibi (Allah have mercy on him) makes clear in his Muwafaqat, the primary interests (maqasid) the Sacred Law came to preserve were the interests of the next life. As for the interests of worldly life, they are of concern in Sacred Law insofar as they are a means to realizing, ensuring, or preserving the interests of the next life.
And Allah alone gives success.
