Question

About 3 years ago I got married and my husband stayed with me 10 days then he left me and went to another country. In the first one year we had contact with each other he used to send me (nafaqa) but after that he did not contact me and he did not give me nafaqa. In all this time I am living with my parents. I want to know for such a situation how long a married woman has to wait for her husband and cannot get separated?

Answer

In the name of Allah, Most Compassionate, Most Merciful,

Marriage can only be terminated by divorce, Khul’ or a valid annulment (faskh). In order for you to be separated from your husband, you need to get him to issue you a divorce. If he is not providing you with the Nafaqa (as you have stipulated), then you may get annulment of your marriage from an Islamic court or an Islamic council. Details of these aspects have been mentioned in earlier posts. [See: Marriage section at www.sunnipath.com]
