Question

A Muslim couple I know did not perform an Islamic nikah. Rather, they married at the court-house and have only the state-issued  marriage license to confirm their marriage. Given the fact that the man was always Muslim and also the fact that there was not even a Christian ceremony performed, is such a marriage valid?  Also, if there is doubt surrounding the validity of this marriage, is it my obligation to inform them of it?

Answer

Assalamu alaikum,

Subhan Allah. The scholars mention that, "Rarely are actions sound without knowledge."

If a Muslim man marries a non-Muslim lady, the presence of Muslim witnesses is not a condition in the Hanafi school. Rather, the main conditions that would have to be met are:

1.There has to be a spoken offer and acceptance. (A written one would not suffice.)

2.Two witnesses must be present, and they must hear the offer and acceptance, knowing that it is a marriage.

Raise the issue with the sister. If these main conditions were met, the nikah is valid, InshaAllah.

Wassalam,
Faraz Rabbani.
