Question

What is the legal ruling in the Hanafi school regarding conjugal relations between a husband and wife after she has completed her menstrual period but before she has performed ghusl? This is assuming she removed all filth from her private parts, but did not yet perform ghusl (as in the question).

Answer

Walaikum assalam wa rahmatullah,

1. If the menstruation is considered to have ended after the ten days maximum duration, then intercourse is permitted without ghusl (purificatory bath), though ghusl is recommended.

2. If the menstruation ended before the ten days maximum, then:

a) if after the completion of her normal menstrual habit (`ada), then intercourse is permitted only after ghusl;

b) if before the completion of her normal menstrual habit, then intercourse remains prohibited and sinful even if the bleeding has stopped.
